These Terms of Service ("Terms") are a legal agreement between you and Airix LLC ("Airix," "we," "us," or "our") governing your access to and use of Pushy — available as a web app at pushy.pl and as mobile apps (available on Google Play, with Apple App Store coming soon) — and any related services we provide (collectively, the "Service").
By downloading, installing, or using Pushy — on the web or on mobile — you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be at least 13 years old to use Pushy. By using the Service, you represent that you are 13 or older and that you have the legal capacity to enter into this agreement. If you are between 13 and the age of majority in your jurisdiction, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.
2. Your Account
To use the Service, you must sign in using Sign in with Google (available on web and mobile) or Sign in with Apple (available on mobile, where offered). You are responsible for:
- Maintaining the security of the account you use to sign in
- All activity that occurs under your account
- Providing accurate information when prompted
- Notifying us promptly at support@pushy.app if you suspect unauthorized access
We may suspend or terminate accounts that violate these Terms, are inactive for extended periods, or that we reasonably believe pose a security or legal risk.
3. Subscriptions, Free Trials, and Billing
3.1 Subscription Service
Pushy offers paid subscriptions that unlock additional features. On the pushy.pl web app, payments are processed by Stripe. In the mobile app, payments are processed through Google Play Billing (Android) or Apple In-App Purchase (iOS), via RevenueCat. Subscription pricing, billing intervals, and feature details are displayed before purchase.
3.2 Free Trials
We may offer a free trial period for certain subscriptions. Unless you cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged at the then-current price, via Stripe (web) or your Google Play / Apple ID account (mobile). Free trials may be limited to one per user, and we reserve the right to modify or end free trial offers at any time.
3.3 Auto-Renewal
Subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel in accordance with Section 3.4. Your payment method will be charged automatically by Stripe (web subscriptions) or by Google or Apple (mobile subscriptions).
3.4 Managing and Canceling Your Subscription
How you manage or cancel your subscription depends on where you purchased it:
- Web (pushy.pl, Stripe): manage or cancel your subscription from your account settings on pushy.pl, or email us at support@pushy.app. Cancelling stops future renewals; you keep access through the end of the period you already paid for.
- iOS (App Store): Settings → [your name] → Subscriptions, at least 24 hours before the end of the current period.
- Android (Google Play): Google Play Store → Profile → Payments & subscriptions → Subscriptions, at least 24 hours before the end of the current period.
We do not control Apple's or Google's billing process and cannot issue refunds directly for purchases made in the mobile app; refund requests for those must be submitted to Apple or Google according to their respective policies. For refund requests on Stripe subscriptions purchased on the web app, email us at support@pushy.app.
3.5 Price Changes
We may change subscription prices from time to time. Price changes will not affect a billing period you have already paid for. We will provide notice through the Service, by email, or via the App Store / Play Store before any price increase takes effect.
4. License to Use the Service
Subject to your compliance with these Terms, Airix grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access the web app and to download and use the mobile app for your own personal, non-commercial use on devices you own or control.
This license does not grant you the right to:
- Copy, modify, distribute, sell, lease, or sublicense any part of the Service
- Reverse engineer, decompile, or attempt to extract the Service's source code
- Use the Service to build a competing product or service
- Remove or alter any proprietary notices in the Service
- Use the Service in violation of any applicable law or regulation
5. Acceptable Use
When using Pushy, you agree not to:
- Use the Service for any unlawful purpose or in violation of these Terms
- Attempt to gain unauthorized access to our systems, other users' accounts, or any data not belonging to you
- Interfere with, disrupt, or overload the Service or its underlying infrastructure
- Use automated tools, bots, or scripts to interact with the Service in ways not intended
- Submit false, misleading, or fraudulent information
- Circumvent subscription, trial, or access restrictions
6. Health and Fitness Disclaimer
Pushy is a fitness tracking and motivation app, not a medical service. The Service, its content, and any information it provides:
- Are for general informational and motivational purposes only
- Do not constitute medical, health, or fitness advice
- Are not a substitute for professional medical advice, diagnosis, or treatment
You should consult a qualified healthcare provider before beginning any new exercise program. Stop exercising and seek medical attention if you experience pain, dizziness, shortness of breath, or any other concerning symptoms. You assume all risks associated with using the Service and engaging in physical activity. Airix is not responsible for any injuries, health issues, or other harms resulting from your use of the Service.
7. Intellectual Property
The Service, including all software, design, text, graphics, logos, and other content (excluding any content you submit), is owned by Airix LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws.
"Pushy" and the Pushy logo are trademarks of Airix LLC. You may not use these marks without our prior written permission.
8. User Data
Your use of the Service is also governed by our Privacy Policy. The Privacy Policy describes how we collect, use, and protect your information.
You retain ownership of any workout data you generate through the Service. By using the Service, you grant Airix a limited license to store, process, and use that data as needed to provide the Service to you.
9. Third-Party Services
The Service relies on third-party services, including authentication providers (Google, Apple), backend infrastructure (Supabase), and payment processing (Stripe on the web app; RevenueCat together with Google Play Billing or Apple In-App Purchase on mobile). Your use of these services is also subject to their respective terms and privacy policies. We are not responsible for the acts or omissions of these third parties.
10. App Store Terms
You acknowledge that these Terms are between you and Airix LLC, not with Apple or Google. The App Store and Play Store are not responsible for the Service or its content. Purchases made through an app store are additionally subject to that store's own terms and refund policies.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, whether express, implied, statutory, or otherwise. To the fullest extent permitted by law, Airix disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, Airix LLC and its officers, employees, agents, and affiliates will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or related to your use of the Service.
Our total cumulative liability for any claims arising out of or related to these Terms or the Service will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD $50. Nothing in this Section limits any rights you may have as a consumer that cannot lawfully be limited.
13. Indemnification
You agree to indemnify, defend, and hold harmless Airix LLC and its officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your violation of these Terms; or (c) your violation of any rights of another party.
14. Termination
You may stop using the Service at any time and delete your account — see our account deletion page. We may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, if required by law, or if we discontinue the Service.
15. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Wisconsin, United States, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Service will be resolved in the state or federal courts located in Wisconsin, subject to Section 16 below for consumers located in the European Union.
16. Consumer Rights (EU / Polish Users)
If you are a consumer resident in Poland or another European Union member state, you retain any mandatory consumer protection rights that these Terms do not limit, including generally a 14-day right to withdraw from a distance contract without giving a reason. For digital content or services that begin immediately (such as unlocking Pushy's premium features), this right of withdrawal may end once performance has begun if you gave express consent and acknowledged the loss of the withdrawal right, as disclosed during the web checkout flow. Purchases made through Google Play or the Apple App Store are additionally subject to those stores' own refund and cancellation policies. Nothing in this Section restricts any rights you have under mandatory Polish or EU consumer protection law.
17. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last Updated" date at the top of this page. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
18. Miscellaneous
- Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Airix regarding the Service.
- Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
- No waiver: Our failure to enforce any provision is not a waiver of our right to do so later.
